How does the UA User Accessibility platform use cookies and personal data?

UA User Accessibility collects personal information such as name, phone number, and email address, and uses Session and Persistent Cookies for user identification, personalisation, and data security. Information may be shared with third parties including Google, Meta, and Cloudflare for operational, analytics, and service improvement purposes. For the purposes of the following Privacy and Cookie Policy, and the License Agreement (as defined below), the following terms shall have the meanings set out beside them, unless the context requires otherwise or is otherwise defined herein:

"Terms of Use"The terms governing use of the System.

"User" – Any person granted by the Company the right to use the System in accordance with the Terms of Use, including a primary user (as defined in the Terms of Use) and a sub-user (as defined in the Terms of Use).

"Content" Any content uploaded to the System in any format or media, including videos, images, text, recorded tutorials, written guides, and sample code snippets.

1.      Entering into the Agreement

As set out in the Terms of Use for the Website and the System, use of the System is subject to and conditional upon acceptance of this Privacy and Cookie Policy. Acceptance of the terms of this Privacy and Cookie Policy is a condition of and an integral part of using the System.

2.       Privacy

  1. The privacy of Users of the System is important to the Company, which makes every effort to protect it. Users should be aware that the Company may disclose their personal information to third parties as part of operating the System and/or in order to comply with applicable local laws, to the extent required to do so. The Company's policy regarding the handling of information collected in connection with use of the System is detailed below.
  2. As part of using the System, the Company will collect and store the following personal details, to the extent provided by the User: full name, phone number, email address, date of birth (optional), address (optional), and social media profile details (optional) (hereinafter: "Personal Information"). The Company shall be entitled to use Personal Information in the course of operating the User's use of the System (including after use of the System), as well as for internal purposes and for the purposes of investigating complaints and/or reviews, including by means of "Cookies" (as defined below), as detailed in Section 2.4 below.
  3. As part of using the System, the User may provide the Company with personal details of their clients who own the websites made accessible through the System by the User (hereinafter: "the Client"). The Company shall be entitled to store the Client's personal details provided by the User, which shall include full name, phone number, email address, and postal address (hereinafter – "Client Information"). The User shall only enter Client Information into the System where the transfer of such information to the Company and the permitted use thereof as described in this Privacy and Cookie Policy has been authorised by the Client. The provision of Client Information is the User's responsibility, and uploading such information shall constitute confirmation to the Company of the Client's consent to the transfer and use of that information as described in this Privacy and Cookie Policy.
  4. The Company shall be entitled to use Client Information as detailed in Section 2.5, in connection with matters related to or arising from the User's use of the System.
  5. The User agrees that the Company may use their personal details and those of the Client (including after use of the System), including sharing them with third parties, solely for the following purposes:
    1. Improving the User's experience with the System and developing additional features for the System;
    2. Processing the User's credit card payments;
    3. Enforcing this Privacy and Cookie Policy and/or the Terms of Use, including investigating possible violations of their provisions;
    4. Detecting and preventing fraud, and addressing technical or security-related issues;
    5. Handling User enquiries and providing User support;
    6. Handling potential User claims that content published on the Website infringes third-party rights;
    7. Protecting the rights, property, or safety of the Company and/or its representatives and/or the public;
    8. Collecting, storing and/or managing the User's and Client's Personal Information through the Company's service providers, who may be located outside the User's country and may be subject to different privacy laws, including in relation to artificial intelligence services provided by, among others, Google and IBM.
  6. The System will monitor the accessibility of websites made accessible through it, and as part of this process, general information about those websites will be collected, including their structure. In addition, anonymous information about visitors to accessible websites will be collected, including the features used by visitors on the accessible website, their IP address, and geographic location. The User shall be responsible for informing the Client of the foregoing, and for ensuring that the Client adds a reference to the foregoing in the privacy policy of the accessible website.
  7. The Company shall be entitled to send promotional and marketing materials, newsletters, and the like to any User who has consented to receiving them.
  8. The User shall be entitled to notify the Company in writing, or via the same channel through which such materials were sent, of their refusal to receive the materials referred to in Section 7 above, whereupon the Company will remove them from its mailing list.
  9. To the extent that the Company is required by a competent authority to provide a User's Personal Information, it shall do so subject to a court order or any other lawful directive.
  10. The Company may use the services of third parties, such as (but not limited to): (a) Google and Meta, to enable use of the System, such as for the purpose of logging in (Log-in); and (b) server services provided by, among others, Intercloud, located in Germany, and Cloudflare, in the countries in which it operates, and in accordance with their respective privacy policies (which can be found at https://www.cloudflare.com/privacypolicy). The Company recommends that Users read the terms of use and privacy policies of such third parties.
  11. The Company may also use Google Analytics (Google Analytics), a Google tool that helps the website analyse User activity on the site. Information collected through this tool is stored on Google's servers, including the visitor's IP address and the URL of the web page being visited. To the best of the Company's knowledge, Google uses this information to evaluate User activity on the website and to generate reports for website operators regarding website activity and internet usage. Google may also transfer such information to third parties where required by law or where such third parties process the information on Google's behalf. To the best of the Company's knowledge, Google will not associate the User's IP address with any other data held by Google.   12. The Company uses professional security systems to protect the information collected under this Privacy Policy. Such services include periodic audits and backups. Nevertheless, although the Company is committed to information security and makes every effort to protect the data collected, the Company shall not be liable for any security failures that may occur beyond its control.
  13. The User may request that the Company allow them to view, delete, or amend information collected about them by contacting the Company at the following email address only: [email protected], and the Company will make reasonable efforts to comply with the User's request, subject to applicable law.
  14. Unless the User and/or Client instructs the Company otherwise, the Company shall be entitled to retain the User's and/or Client's Personal Information for as long as necessary for the purposes set out in this Privacy Policy, subject to applicable law. The Company shall be entitled to retain non-identifying User information for an unlimited period.

3.      Cookies ("Cookies")

  1. Like most websites, the Website and the System use cookies (“Cookies”) – small text files stored on the User's computer hard drive that allow the Company or third parties to identify the User, analyse the User's online activity, and provide a more convenient browsing experience and smoother use of the System. Cookies are also used to verify User credentials, personalise the application to the User's preferences, and for data security and statistical data collection purposes. It should be noted that these cookies will not contain personal details.
  2. In addition, cookies may be used by third parties, such as Google, to display marketing content to the User on other websites the User has visited.
  3. The Website and the System use “Session Cookies”, which are generally deleted when a User leaves the Website and the System or closes their browser, and “Persistent Cookies” (memory cookies), which are stored on the User's computer and can be deleted by the User. Persistent Cookies are used for the purpose of quickly identifying the User.
  4. Any User may change their browser settings so that cookies do not operate on their computer. In addition, any User may delete cookies stored on their computer at any time. The User acknowledges that they understand that disabling or deleting cookies means that the Website and the System will not be personalised to the User's preferences, or alternatively that the System will not function fully or partially.
  5. Changing cookie settings and/or blocking cookies may impair the User experience and may also impair or entirely prevent the use of certain features of the Website and the System.

4.      General

  1. This Policy, the Website, and the System (including all matters relating thereto, such as their availability and interface) may be changed, replaced, and adapted, in whole or in part, at the Company's sole discretion.
